The popularity, ease and comfort of using ride-sharing services, such as Uber and Lyft, have become many people's first choice for transportation over the past several years. It is a convenient, hassle-free form of transportation especially for a night out where you don't need to worry about drinking and driving, gas costs, or paying expensive parking charges.
These alternate transportation options are great, however, accidents still occur.
The ride-sharing drivers are held to the same rules of the road as other drivers. They are also responsible for the safety of the passengers they are transporting.
Generally, as a passenger in a ride-share vehicle, you likely are not at fault (no- fault passenger) for a vehicular accident involving a ride-share vehicle. Depending on how the accident occurred, and which driver/vehicle caused the accident is an important factor in determining the liable party and which insurance company a ride-sharing passenger should turn to for compensation of injuries and damages. Uber and Lyft may not cover all situations. For example: if another vehicle caused the accident with the ride-share vehicle in which you are a passenger, a claim likely needs to be filed against that adverse, responsible driver's personal insurance.
If you are a passenger in a ride-sharing vehicle that is involved in an accident, obtain both drivers' contact and personal insurance information.
If you are a driver of a vehicle involved in an accident caused by an Uber or Lyft vehicle, determining which insurance company pays for your damages due to the accident depends on what phase of the job the ride-share driver was in at the time of the accident. For example, if the ride-share driver is off line (did not have their App on), then the driver is in personal mode requiring a claim to the driver's personal automobile insurance; or if the driver is logged into the App and in "waiting mode" or accepted a job and is en-route, or has a passenger in the vehicle -these are all different phases of the job, and making the claim to the proper insurance company is important.
It is always a good idea to get all insurance and contact information of the ride-sharing driver (personal and company) and every other vehicle involved in the accident, if you are involved in an Uber or Lyft accident - whether as a passenger in the Uber/Lyft vehicle, driving another vehicle, or a pedestrian involved in the accident, as often times multiple claims may be needed.
