Bus Accident

Passengers in a bus, generally, are unprotected by seat belts or air bags, and even stand or walk freely in the bus. A bus accident occurs when the bus collides with another vehicle or pedestrian. Other times, the bus can skid, lose control, or the driver unreasonably makes a violent, sudden stop causing the bus passengers to be thrown around inside the bus, or fall to the ground. A bus can flip or roll over causing serious and devastating injuries given the number of people in the bus. Other injuries can result from malfunctioning doors, or if the bus operator closes the door prematurely while a passenger is still in the doorway entering or existing the bus. Sometimes, bus drivers drive too fast, disobey the rules of the road, or drive while distracted and cause an accident or injuries to their passengers. A bus driver who acts negligently or recklessly, once proven, will held liable to the party injured in the accident.


In some cases, the bus itself may have malfunctioned due to poor maintenance or upkeep. Or the driver may be inexperienced or not adequately trained. In these instances, the bus company or municipality responsible for the vehicle's maintenance and the driver's training may also be liable to the injured party by proving their responsibility.


If you are a passenger in a bus operated as part of a government entity, such as a school bus, or in an MTA or local city bus, certain time deadlines exist to file your claim with the governmental entity or municipality. Generally, in California, the claim must be filed within 180 days of the accident. The time-frame to file a lawsuit may also be different than the standard two (2) year statute of limitations for car accident/injury cases. Do not risk missing a claim or lawsuit deadline, incorrectly filling out the necessary claim form, or timely filing your claim or the lawsuit.
