When Unsafe Property Conditions Cause Injuries

2. The Owner Knew or Should Have Known
The property owner, manager, or responsible party knew or reasonably should have known about the dangerous condition.
3. The Hazard Was Not Corrected
The responsible party had a reasonable opportunity to repair the condition or warn people about it and failed to do so. Slip, trip and fall cases can be difficult to prove, which makes preserving evidence and documenting what happened especially important.
What You Should Do Immediately
Seek Medical Attention
Seek immediate medical attention for your injuries and continue with your recommended care and treatment. Medical documentation can be important to both your recovery and your case.
Report the Accident
Notify the property owner, manager, or person responsible for the premises as soon as possible. Ask for a copy of the incident report or photograph it with your phone.
Photograph the Hazard
Take photographs and videos of the exact area where you fell and whatever caused your accident before the condition is cleaned, repaired, removed, or changed.
PRESERVE THE EVIDENCE
Evidence Can Disappear Quickly
Witnesses
Obtain the names, addresses, and telephone numbers of anyone who saw your fall or witnessed the dangerous condition.
Surveillance Video
Look for security cameras near the accident location and immediately tell your attorney so that steps can be taken to preserve available footage.
Shoes & Clothing
Keep the shoes and clothing you were wearing at the time of the accident. Do not wash or continue using them. Place them in a paper bag rather than a plastic bag and preserve them for your attorney.
